Terms of Service
These Terms of Service ("Terms") govern your access to and use of the HIRAM AI platform, including our website, mobile applications, and related services (together, the "Platform"). The Platform software is provided by HIRAM AI LLC ("HIRAM"). Warranty Shield LLC is the licensed entity that contracts with builders and provides the certification, inspection, and related professional services offered through the Platform. In these Terms, "we," "us," and "our" refer to HIRAM AI LLC and Warranty Shield LLC together, except where a specific entity is named. By creating an account or using the Platform, you agree to these Terms.
1. What the Platform Does
HIRAM AI is a warranty administration platform. Residential home builders use it to administer the limited warranties they provide to their homebuyers — intake and evaluation of warranty claims, assignment of work to trade partners, scheduling, documentation, inspection, certification, and recordkeeping. Warranty Shield LLC provides inspection and certification services through the Platform.
HIRAM AI is not the warrantor and does not provide the warranty. Your home's limited warranty is a contract between you and your builder. HIRAM AI administers the process on the builder's behalf. Coverage determinations are reviewed and approved by the builder's Review Board. Nothing on the Platform expands, reduces, or replaces the terms of your builder's written limited warranty, and in any conflict, the builder's written warranty controls.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract. Accounts are role-based — homeowner, builder, subcontractor or trade partner, and inspector — and each role sees only the records associated with that role and its properties.
You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
3. Certification Requirements
Builders, subcontractors, and inspectors may be required to complete certification and continuing-education requirements to receive and process warranty work through the Platform. Certification is issued and approved by Warranty Shield LLC. Certifications may expire and require renewal. Failure to maintain certification may limit your ability to receive work assignments through the Platform.
4. Text Messaging Program
The Platform sends service and transactional text messages. By providing your mobile number and checking the consent box during enrollment or onboarding, you agree to receive these messages.
- Message types: warranty claim status and coverage determinations; work order assignments, acknowledgments, and completion sign-off requests; appointment scheduling and confirmations; inspection scheduling and results; enrollment, certification, and recertification notices; scheduled home maintenance reminders; severe weather preparedness notices; post-service satisfaction surveys; and account and service notifications.

- Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- Consent is not a condition of purchase or of warranty coverage.

5. Communications Through the Platform
Communications relating to warranty administration are conducted through the Platform so that they are attributed, timestamped, and recorded in the audit trail. You agree to use the Platform for warranty-related communications rather than side channels, so that the record remains complete and accurate.
6. Your Content
You retain ownership of the photographs, video, documents, and other content you submit. You grant HIRAM a non-exclusive license to host, store, process, display, and share that content with the parties who need it to administer the warranty — your builder, the assigned trade partner, and inspectors — and to maintain the audit record.
You represent that you have the right to submit the content and that it does not infringe the rights of others. Do not upload content that is unlawful, infringing, or that contains sensitive personal information unrelated to the warranty claim.
7. Acceptable Use
You agree not to:
- Access accounts, records, or properties that are not associated with your role
- Submit false, fraudulent, or misleading claims, photographs, or completion records
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Platform
- Upload malware or attempt to introduce code that damages or compromises the Platform
- Reverse engineer, decompile, scrape, or copy the Platform or its underlying technology
- Use the Platform to send unsolicited or unlawful communications
8. Automated Processing
The Platform uses artificial intelligence to assist with classifying claims, matching them to applicable construction standards, and suggesting trade assignments. This output is decision support. Final coverage determinations are reviewed and approved by the builder's Review Board, and inspections are performed by certified inspectors.
9. Intellectual Property
The Platform, including its software, design, content, and the HIRAM AI and Warranty Shield names and logos, is owned by HIRAM AI LLC and Warranty Shield LLC and is protected by intellectual property law. U.S. Patent Pending. These Terms grant you a limited, revocable, non-transferable right to use the Platform for its intended purpose. Construction performance guideline content is used under the rights of its respective publisher.
10. Third-Party Services
The Platform relies on third-party services for hosting, messaging, email, voice, and AI processing. We are not responsible for the availability or performance of third-party services, and their use of information is governed by our agreements with them as described in our Privacy Policy.
11. Disclaimers
The Platform is provided "as is" and "as available." To the fullest extent permitted by law, HIRAM disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that automated classifications will be accurate in every case.
HIRAM does not perform construction work and does not guarantee the workmanship of any builder, subcontractor, or inspector.
12. Limitation of Liability
To the fullest extent permitted by law, HIRAM AI LLC and Warranty Shield LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of the Platform. Our total aggregate liability arising out of or related to the Platform will not exceed the greater of the amounts you paid us in the twelve months preceding the claim, or one hundred U.S. dollars.
Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here limits or waives any rights you have under your builder's written limited warranty or under applicable consumer protection law.
13. Suspension and Termination
We may suspend or terminate access for violation of these Terms, for suspected fraud, or where required by law. You may stop using the Platform at any time. Warranty records, determinations, and completion documentation will be retained as described in the Privacy Policy.
14. Changes to These Terms
We may update these Terms. We will revise the "Last updated" date above, and for material changes we will provide notice through the Platform. Continued use after changes take effect constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Nothing in this section limits any statutory rights or procedures applicable to residential construction claims, including any notice and opportunity-to-repair requirements under applicable Florida law.
